官方发文：医疗行业恶意投诉泛滥，全面整治刻不容缓！

  近日，黑龙江省绥化市卫生健康委官方发文直指医疗恶意投诉泛滥的行业乱象。这早已不是个别地区的问题，而是全国医疗机构、一线医护共同面临的困境。无序的恶意投诉，正在透支医疗资源、打击医护信心、撕裂医患信任，一套系统性、双向约束的整治方案，已然迫在眉睫。

  恶意投诉泛滥，考核机制失衡是核心

  医疗恶意投诉愈演愈烈，并非单纯的医患矛盾，而是多重机制失衡叠加的结果。

  （一）制度考核导向失衡（核心内因）各级卫健、医院将投诉量、12345办结率与绩效考核、财政拨款、科室评优、医护绩效强绑定，简单以“零投诉”为硬性指标，形成“投诉即扣分、扣分即罚款”高压链条。投诉处置一刀切：不分诉求合理与否，工单下达即要求医院自查、致歉、处罚医护，缺乏前置事实核查机制，医院为避免考核扣分，倾向“息事宁人、赔钱了事”，变相纵容恶意投诉。诉求分流机制缺失：12345热线边界模糊，物价、停车、环境等非医疗问题全部派单医院兜底，无限增加医护处置负担。

  （二）维权成本严重不对等投诉方成本极低：一通电话、一条短视频即可发起投诉，重复投诉无次数限制；医方自证成本极高：调取病历、组织专家复核、准备答复材料、配合多部门核查，耗费大量临床与行政人力；医疗鉴定周期长、流程复杂，普通医患缺乏便捷中立快速判定渠道。

  （三）社会认知与舆论环境偏差公众普遍存在“患者天然弱势”刻板印象，网络平台天然同情投诉者，不实医疗负面内容极易流量发酵，客观降低造谣、抹黑成本；医疗科普不足，大众不理解医学局限性、诊疗客观风险，将疾病自然转归、个体差异全部归责于医院。

  （四）惩戒约束机制不完善过去长期缺少恶意投诉认定标准、失信惩戒规则，反复缠诉、网络造谣、职业碰瓷难以有效约束；多部门协同不足：卫健、公安、市场监管、网信联动处置滞后，线下闹事、线上网暴分开处理，打击力度分散；信用体系未落地：捏造事实、恶意索赔人员未纳入公共信用黑名单，无联合限制措施。

  （五）医疗风险分担渠道利用不足医疗责任险、医疗意外险普及不均衡，部分医院遇纠纷优先私下协商赔付，未引导走医调委、保险理赔、司法途径，滋生“以投诉换赔偿”投机空间。

  行业代价惨重，医患双方皆是受害者

  泛滥的恶意投诉，正在让整个医疗行业买单，最终损害所有医患的利益。

  对医护而言，长期无端追责容易催生投诉后应激障碍，进一步催生防御性医疗，损害患者整体利益。

  医护产生“投诉PTSD”，诊疗优先规避风险：高难度手术不敢开展、必要有创检查能省则省，同时过度开具检查、留存自保证据，推高就医成本、延误重症救治。

  挤压临床资源，加剧医疗人力消耗

  医务科、临床科室大量精力用于应对重复工单、信访、舆情处置，挤占诊疗、科研、患者服务时间，基层医院人手短缺问题进一步恶化。

  打击医务人员执业信心，加剧人才流失

  无过错医护被罚款、停职、网暴，职业尊严受损，青年医学生报考意愿下降，基层、急诊、产科等高风险科室人员流失加剧。

  对行业和社会而言，无休止的投诉、信访、舆情处置，挤占了诊疗和科研核心资源，同时医患对立情绪加剧。

  破坏正常医患信任闭环

  医患对立情绪加剧，正常沟通充满防备，轻微矛盾极易升级为投诉纠纷，形成“不信任—投诉更多—更不信任”恶性循环。

  浪费公共行政资源

  卫健、信访、政务热线、公安重复处置同一无依据诉求，公共治理资源被职业投诉人、缠访者持续占用。

  国家现行治理政策依据

  目前，多项法律法规与新政，已为整治恶意投诉提供明确依据。

  《医疗纠纷预防和处理条例》：明确医患纠纷法定解决路径(协商、医调、行政调解、诉讼)，禁止以扰乱秩序、网络造谣方式维权;

  《医疗机构投诉管理办法》：要求投诉处置先核查事实，不得简单以投诉处罚医务人员，建立医警联动应急机制;

  2026年4月实施《市场监督管理投诉举报处理办法》：明确禁止滥用投诉举报牟取不正当利益，对职业恶意投诉可不予受理、移送公安追责;

  新版《治安管理处罚法》：对扰乱医疗机构秩序、侮辱医务人员、网络诽谤加大拘留惩戒力度，情节严重追究寻衅滋事、敲诈勒索刑事责任;

  卫健委2024年投诉管理通知：要求区分合理诉求与恶意投诉，健全第三方调解、投诉终结机制，杜绝“一刀切考核”。

  分层落地综合治理对策

  整治工作已有清晰政策抓手，行业治理需从考核、认定、维权分流、联合惩戒、院内风控、社会科普六大维度同步推进。

  （一）优化考核机制，从源头减少“息事宁人”动机改革投诉考核指标：取消“零投诉”硬性要求，区分有效投诉（医院存在过错）与恶意/无效投诉，无效投诉不扣分、不与绩效挂钩；建立前置核查机制：12345、信访工单先由卫健、医调委初步研判，无事实依据工单免于医院全面追责；严禁“未查先罚”：所有针对医护的处罚必须附完整病历、专家复核、事实调查材料，杜绝简单问责。

  （二）明确恶意投诉认定标准，建立投诉终结机制统一界定恶意投诉情形：虚构诊疗过错、伪造证据、重复缠访超3次且拒绝鉴定/诉讼、网络造谣抹黑、以投诉要挟高额索赔、职业代理碰瓷；推行一事一终：经医调、鉴定、司法出具无责结论后，同一诉求不再重复受理、不再重复派单，杜绝无限循环投诉。

  （三）完善多渠道分流，引导理性合法维权强制前置第三方调解：索赔超1万元纠纷，第一时间引导至免费医疗纠纷人民调解委员会，由医学、法律专家中立判定，减少私下协商妥协；普及医疗意外险、医疗责任险：由保险机构统一赔付，隔离医院与患者直接经济博弈；清晰告知法定维权路径，明确告知“反复恶意投诉无法获取赔偿，将承担法律责任”。

  （四）多部门联动惩戒，抬高恶意投诉违法成本卫健+公安医警联动：线下围堵、辱骂、扰乱诊疗秩序，当场出警，依法治安拘留；以曝光、威胁手段索要钱财，固定证据移送公安追究敲诈勒索罪；网信+平台治理网络医闹：平台快速下架不实涉医视频，封禁反复造谣账号；留存侵权证据，支持医务人员起诉名誉侵权，要求赔礼道歉、赔偿精神损失；建立医疗失信联合惩戒库：对恶意投诉、职业碰瓷人员纳入信用记录，限制医保绿色通道、信访优先接待等公共服务，涉嫌违法线索移送司法；市场监管部门对医美、口腔职业投诉人直接不予受理，涉嫌欺诈索赔立案查处。

  （五）医疗机构内部全流程风险防控全流程留痕：门诊、沟通、诊疗全程录音录像，规范完整书写病历，固定无过错证据；专业化投诉处置：配备医学+法律专职投诉专员，引入社工、律师参与接待，避免激化矛盾；投诉接待室设一键报警、监控，紧邻警务点；强化医患沟通培训：提升医护人文沟通能力，术前充分告知医疗风险，从源头减少误解类投诉；建立医护维权绿色通道：遭遇恶意投诉、网暴，医院统一对接公安、律师，承担维权成本，公开澄清事实，保护医务人员名誉。

  （六）社会层面修复医患信任常态化医学科普，客观普及医疗局限性、疾病风险，消解“医疗完美主义”预期；媒体平衡报道，既监督医疗不规范行为，也客观报道医务人员遭受恶意投诉、网暴的困境；普法宣传，明确告知群众：恶意投诉、网络造谣、医闹均属于违法行为，需承担民事、行政乃至刑事责任。
