以法之力维护医保基金安全——从四个案例看如何严惩医保骗保犯罪

  医保基金是亿万群众生命健康的“兜底保障”，其安全稳固关乎国计民生。

  近年来，医疗保障网络持续织密，与此同时，医保基金监管也面临复杂挑战，医保骗保犯罪花样不断翻新：从个别参保人虚构病情、重复报销的“小动作”，到职业骗保产业链，违法犯罪行为严重侵蚀医保基金安全。

  2024年，全国法院一审审结医保骗保犯罪案件1156件，判处罪犯2299人，一审结案数同比增长131.2%，挽回医保基金损失4.02亿余元。

  医疗机构哪些所谓的“经营手段”属于医保骗保？个人利用医保政策骗保将承担怎样的法律责任？如何筑牢医保基金的安全防线？近日，最高人民法院披露了4起医保骗保犯罪案件，曝光“回流药”黑色产业链等骗保手段，展现了司法机关依法全链条惩治医保骗保犯罪、守护群众“看病钱”“救命钱”的鲜明态度。

  打掉医疗机构“蛀虫”

  民营医院在充实医疗力量，保障人民群众就医、购药方面发挥重要作用。但有的民营医院及其工作人员为获取非法利益，采用虚假手段骗取国家医保基金，严重危害医疗保障制度健康持续发展。

  几年前，艾某忠在山西大同市出资设立某医院后，便盘算上了骗保“生意经”。他们到周边县区，以各类幌子四处吸引、招揽患者住院，还“动员”本医院的职工及家属“住院”。

  “招揽的对象主要针对病情较轻、有基础病的老年人。收取少量住院押金后，住院期间的医保卡由医院保管。住院者的实际治疗费用仅为一两千元，但医院通过虚增药品、检查项目，将报销金额提升至医保报销上限，以骗取国家医保基金。”山西省大同市中级人民法院承办法官郑翔介绍，该医院的内科和骨科是骗保的主力科室，其他科室辅助打配合。在案证据显示，艾某忠等人还采取虚增药品进价、药品重复入库，虚报床位、空挂床等方式和手段大肆提高、虚构住院费用，并通过制作假病历等方式，达到骗取国家医保基金的目的。

  短短两年间，该医院虚报金额高达970余万元，其中700余万元骗取成功、200余万元还未拨付。

  这起典型的医疗机构骗保案，最终难逃法网。经法院审理，认定艾某忠等人构成诈骗罪且数额特别巨大，对主犯艾某忠等六人依法从严惩处，判处十年以上重刑，并处50万元至10万元不等罚金。

  在另一起案件中，杜某君作为某定点医疗机构的实际控制人，为非法牟利，采取低价或免费住院治疗等方式，吸引大量中老年医保患者住院治疗，提供吃药、雾化、输水等基础医疗服务，并大量开具高利润抗生素等药品。

  为使住院者符合住院要求和逃避查处，杜某君指使或默许工作人员弄虚作假，修改住院者的血常规检验报告等，制作虚假病历，通过医保报销骗取医保基金390多万元。最终，杜某君被以诈骗罪判处有期徒刑十二年，并处罚金50万元。

  两起案件暴露出部分医疗机构将“救命钱”视为“唐僧肉”的贪婪本质。“组织者要从重惩处。”最高人民法院刑三庭法官张若瑶表示，《关于办理医保骗保刑事案件若干问题的指导意见》进一步强化了对职业骗保人、医保骗保组织者的打击力度，在这两个案例中，起主要作用的被告人均被判处十年以上有期徒刑，彰显了司法机关对侵蚀医保基金“根基”的“蛀虫”零容忍的态度，形成了强大震慑。

  守护医保基金安全，必须实施全链条打击。

  近年来，非法收购、销售医保骗保购买的药品违法犯罪形势十分严峻。一些犯罪分子组成犯罪团伙，通过非接触式手段，倒卖医保骗保药品非法牟利。

  戴某寿便是参与“回流药”黑色产业链的不法分子。在无药品经营许可证、营业执照等相关资质情况下，戴某寿通过微信联系上下家收购、销售“医保回收药品”，并租用仓库作为场地，雇佣他人负责打包、邮寄药品。

  经核实，戴某寿将所收购的“医保回收药品”销售给冀某洲、彭某等人，共收款390余万元。案发后，公安机关扣押药品数万盒。根据相关法律规定：明知系利用医保骗保购买的药品而非法收购、销售，金额五万元以上的，应当依照刑法第三百一十二条的规定，以掩饰、隐瞒犯罪所得罪定罪处罚。江西省浮梁县人民法院审理后判处戴某寿有期徒刑六年，并处罚金12万元。

  “倒卖医保骗保药品，不仅造成医保基金损失，还造成大量药品得不到妥善保管而浪费，部分变质药品再次流入销售环节，危害人民群众身体健康，成为治理医保骗保违法犯罪的重要环节。”张若瑶介绍，人民法院对医保骗保犯罪全链条惩治，上挖源头、下断通道，斩断非法利益输送链，压缩犯罪生存空间，切实维护医保基金安全和人民群众医疗保障合法权益。

  警惕参保人非法转卖药品

  医保骗保手段层出不穷，除机构系统性造假和下游销赃外，还包括参保人直接套保等隐蔽方式。

  最高人民法院发布的一起典型案例给参保人提了醒。为牟取利益，参保人陶某云从2023年开始，滥用医保报销政策，自己本来没有心脑血管疾病、哮喘、精神病等病史，却持医保卡多次到多家医疗机构多开、虚开治疗这些疾病的药品，并将价值22万多元的药品低价出售给他人。

  其间，陶某云在结识徐某侠后，接受徐某侠授意，持医保卡在多家医疗机构虚开价值8万余元的药品，并以低价卖给徐某侠。

  根据相关法律法规规定，参保人员不得利用其享受医疗保障待遇的机会转卖药品，接受返还现金、实物或者获得其他非法利益。“参保人利用医保待遇转卖药品牟利，以及教唆、收购此类药品者，均已触碰法律红线。”江苏省南京市六合区人民法院审理认为，陶某云、徐某侠均构成诈骗罪，分别判处有期徒刑三年二个月、一年七个月。

  医保基金是广大人民群众共享的普惠性资源、有限资源，参保人员作为政策红利的受益者，也负有依法、如实享受医保待遇，维护医保基金健康可持续发展的义务。

  如果参保人个人非法转卖药品，会面临怎样的法律后果？

  对此，最高人民法院提示，个人利用享受医疗保障待遇的机会转卖药品，接受返还现金、实物或者获得其他非法利益的，由医疗保障行政部门责令改正；造成医疗保障基金损失的，责令退回；属于参保人员的，暂停其医疗费用联网结算3个月至12个月。个人以骗取医疗保障基金为目的，造成医疗保障基金损失的，还应当由医疗保障行政部门处骗取金额2倍以上5倍以下的罚款。行为人以非法占有为目的，实施前述行为，骗取医疗保障基金支出，符合刑法第二百六十六条规定的，以诈骗罪定罪处罚。

  “人民法院对骗取医保基金的犯罪分子绝不姑息。”最高人民法院相关负责人表示，下一步，将全力推进打击整治医保骗保犯罪工作，坚决维护医保基金安全。

  医保骗保犯罪的四大特点

  据最高人民法院刑三庭相关负责人介绍，医保骗保犯罪主要有以下四个方面特点：

  一是所涉罪名集中化，主要为诈骗罪。医保骗保犯罪涉及诈骗罪，掩饰、隐瞒犯罪所得罪，贪污罪等多个常见罪名，其中诈骗罪占90%以上。

  二是犯罪主体多元化，参保人员占比较大。医保骗保的犯罪主体包括定点医疗机构及其人员、定点零售药店及其人员、参保人员及其近亲属、职业骗保团伙以及其他人员，部分案件还涉及药品生产企业。其中，参保人员涉案占比较大。

  三是犯罪手段多样化，职业骗保专业化。实践中，医保骗保犯罪手段主要有伪造证明材料、虚开费用单据、虚构医药服务、分解项目、串换药品、冒名就医、购药及利用享受医疗保障待遇转卖药品等，各种犯罪行为相互交织，部分职业骗保人组织化、分工化程度越来越高，团伙化、专业化特征明显。

  四是犯罪数额巨大，社会危害严重。有的医保骗保犯罪隐蔽性强，持续时间长，涉案金额巨大，造成巨额医保基金损失，严重损害医疗保障制度的健康持续发展。

  最高人民法院刑三庭相关负责人表示，将始终坚持依法从严惩处医保骗保犯罪，同时把追赃挽损贯穿办理案件全过程和各环节，综合运用多种手段，全力追赃挽损，最大程度减少医疗保障基金损失，最大限度维护人民群众利益。
