国家医保局：进一步加强医疗保障定点医疗机构管理

  《医疗机构医疗保障定点管理暂行办法》（国家医保局令第2号，以下简称“2号令”）实施以来，各地认真贯彻落实政策要求，加强和规范定点管理，为赋能医疗机构发展、提高医保基金使用效率、更好保障广大参保人员权益发挥了积极作用。但同时也存在医保定点资源配置不均衡、管理能力和手段相对滞后、协议管理不够规范等问题。特别是近些年医保基金监管工作中发现，部分医保定点医疗机构虚假诊疗服务、伪造医学文书等行为高发频发，严重影响医保基金安全，损害参保人员合法权益，引起社会广泛关注。为进一步加强管理，结合当前新形势、新要求，国家医疗保障局起草了《关于进一步加强医疗保障定点医疗机构管理的通知》。以下为《通知》全文：

  国家医疗保障局关于进一步加强医疗保障定点医疗机构管理的通知

  一、深刻认识加强定点医疗机构管理的重要意义

  定点医疗机构是参保群众获得基本医疗服务的主要场所，是促进医疗、医保、医药协同发展和治理的关键环节。各地医保部门要坚持以习近平新时代中国特色社会主义思想为指导，全面贯彻落实党的二十大和二十届二中、三中全会精神，坚持以人民为中心的发展思想，深刻汲取无锡虹桥医院和重庆永川区卧龙医院、大康医院等不法医疗机构大肆欺诈骗保的教训，把加强定点医疗机构管理作为推进医保高质量发展、提升医保现代化治理能力的重要方面，依法依规强化协议管理，从严从实抓好医保基金监管，促进定点医疗机构提升管理服务水平，确保医保基金安全和参保群众医保权益。

  二、严把定点医疗机构入口关

  （一）合理确定定点医疗机构资源配置。各统筹地区医保部门要综合考虑群众医疗需求、医保基金支撑能力、区域医疗卫生资源规划等因素，合理确定本地区定点医疗机构资源配置，经征求同级卫生健康等部门意见后，报省级医保部门审核。各地要认真落实资源配置要求，严格定点医疗机构入口管理，科学动态做好调整，确保医保基金安全可持续。

  （二）细化定点医疗机构申报条件。申请成为医保定点的医疗机构应符合《办法》所要求的基本条件，并按规定使用药品耗材追溯码，实现“应采尽采、依码结算、依码支付”；开展检查检验服务的，要确保至少有1名具有相应资质的医技人员，严禁医务、医技人员在定点医疗机构内“挂证”，而由他人代为开展诊疗；按规定妥善储存并上传参保患者检验、影像等原始资料，优先支持承诺通过全国统一的医保信息平台上传、调阅检查检验结果的医疗机构纳入医保定点。

  （三）规范执行医药服务价格政策。纳入定点的公立医疗机构提供的基本医疗服务统一执行政府指导价。非公立医疗机构申请纳入医保定点的，应承诺执行与公立医疗机构相同的医疗服务价格项目和价格水平，并按照公平合理、诚实信用、质价相符的原则确定所提供药品、医用耗材价格，原则上不高于所在统筹地区其他定点医疗机构价格水平。各地医保部门要指导定点医疗机构做好医疗服务、药品、医用耗材价格信息公开公示。

  （四）加强新纳入定点医疗机构的管理。对于新纳入医保定点的医疗机构，设立6个月政策辅导期，有针对性指导定点医疗机构落实医保管理及支付相关政策要求。政策辅导期内，除区域医疗中心外原则上不开通异地就医医保结算服务，统筹地区医保部门要点对点加大医保政策辅导力度，强化医保法律、法规、规章、政策以及违法违规典型案例培训，加强警示教育，通过政策培训、上门宣讲、信息共享、检查提醒等方式做好服务。政策辅导期内出现违反协议约定或违反医保政策规定的，医保部门应及时辅导、纠正，并增加政策辅导频次。政策辅导期内出现违规问题，情节较轻的，政策辅导期延长6个月，延长期内整改不到位的不予续签医保协议；情节严重的，直接解除医保协议。

  三、加强定点医疗机构日常管理

  （五）强化协议履约管理。统筹地区医保经办机构要按照《国家医疗保障局关于印发〈定点医疗机构医疗保障服务协议范本〉的通知》（医保发〔2024〕22号）要求，进一步细化完善协议文本内容，加强日常履约核查和费用审核。做好定点医疗机构费用审核工作，对定点医疗机构上传的费用进行智能审核全覆盖。加强定点医疗机构事前提醒，推动全量数据上传，强化大数据应用，提高智能审核能力和水平。逐步实现本地费用与异地费用同质化审核。落实预付金政策，加快推动与定点医疗机构即时结算，更好发挥医保基金“赋能金”的作用。

  （六）加强医保支付管理。定点医疗机构应按照医保支付方式改革工作要求，积极配合医保部门推进按病种付费等多元复合医保支付方式，规范病案管理，落实病案首页、医保结算清单质控有关规定。严禁以病组或病种费用限额、医保政策规定等为由，要求患者院外购买或自备药品、医用耗材，以及强制患者出院或减少必要的医疗服务。因自身配备等原因，住院期间定点医疗机构要求患者院外购买或自备药品、医用耗材的，原则上应计入按病种付费费用及医疗机构医保总额。

  （七）推动药品和医用耗材平台采购。定点公立医疗机构需通过省级医药集中采购平台统一采购所需药品和医用耗材，实际采购价低于平台价的，要及时向采购平台报告。新增纳入的定点医疗机构，自协议签订之日起执行平台采购流程。已纳入医保定点的医疗机构，设置一定的过渡期，逐步实现全面平台采购。省级医药集中采购平台要应用药品耗材追溯码，实现“无码不采”“无码不付”。鼓励和引导医保定点非公立医疗机构自愿参加集中采购，优先使用质优价宜的集采中选产品。确需自主采购的医保定点非公立医疗机构，要按不超过平台挂网价销售药品和医用耗材，并执行“无码不采”。

  （八）规范医保药品外配处方管理。各地医保部门要指导定点医疗机构按照相关要求和医保协议约定配备诊疗所需药品，暂时无法配备但确需使用的，应当为参保人提供必要的处方外配服务并加强管理。各地要依托全国统一的医保信息平台，抓紧部署应用医保电子处方中心功能，连通医保经办机构、定点医疗机构、定点零售药店，确保电子处方顺畅流转。

  （九）落实医保支付资格管理要求。各地医保部门要会同有关部门落实《国家医保局国家卫生健康委国家药监局关于建立定点医药机构相关人员医保支付资格管理制度的指导意见》（医保发〔2024〕23号）要求，指导定点医疗机构相关人员按照医保协议约定，作出并履行服务承诺，做好相关人员信息维护和动态更新。对相关人员采取“驾照式”记分，对一个自然年度内记分达到一定分值的，按规定采取暂停、终止医保支付资格等措施。

  （十）做好重点人群住院管理。各地医保部门要落实有关文件要求，对困难群众就医实行单独定点，保障困难群众权益。充分运用大数据分析等手段，加强对精神疾病、医疗康复病人以及医疗救助对象等特殊群体住院行为的监测，及时发现、准确排查异常住院风险。分类标识因慢特病等需多次住院的患者，及时提供相应的医保服务。重点监测长期住院、高频住院、费用畸高或一定时间内反复入院治疗的参保人，确有疾病诊疗需求的，可综合施策为其就近就医提供支持和便利。

  四、保持基金监管严的基调不放松

  （十一）健全定点医疗机构退出机制。各地医保部门要立足实际完善定点医疗机构退出机制，细化退出具体要求。除《条例》和《办法》规定情形外，对医疗机构存在无资质人员冒名行医、涉嫌虚构医药服务项目、伪造检查检验报告、编造病历、提供虚假处方、诱导协助他人冒名就医或虚假就医购药等可能造成重大风险的，应暂停医保基金结算，经查实确有欺诈骗保行为的，及时解除医保协议；医疗机构未按法律法规规定和医保协议要求保管、提供医学文书、医学证明、会计凭证、电子信息等有关资料的，应暂停医保基金结算，在规定时间内（原则上7天内）仍不能提供的，及时解除医保协议；医疗机构隐匿或销毁医学文书、医学证明、会计凭证、删改相关信息系统及监控记录等电子信息、不提供检查相关材料、集体串供等拒不配合检查、情节恶劣的，及时解除医保协议。

  （十二）持续强化基金监管。各地医保部门要结合医保基金管理使用突出问题专项整治，健全完善医保基金使用常态化监管机制，持续开展飞行检查和专项检查，用好举报奖励机制。强化大数据赋能监管，深入推进医保反欺诈监管应用试点，全面推进追溯码监管应用。完善医保智能监管知识库、规则库，依托医保智能监管子系统，实现事前、事中、事后全流程监管，加大异常结算数据核查力度。结合既往年度国家飞行检查、省级飞行检查、线索核查、专项整治中发现的普遍问题和典型案例，系统梳理并制定定点医疗机构自查自纠问题清单，指导定点医疗机构深入开展自查自纠，推动存量问题全面整改。

  （十三）推动行行、行刑、行纪衔接。各地医保部门在监督检查中发现定点医疗机构涉嫌违反医疗卫生领域有关法律法规的线索，及时移交卫生健康行政部门，形成打击欺诈骗保工作合力。与公安机关、纪检监察机关加强协作配合，明确医保基金违法违规案件中涉嫌犯罪的移送标准，符合条件的案件及时移送公安机关立案侦查。落实向纪检监察机关移送问题线索与信息贯通工作机制，对在医保基金监管过程中发现的涉嫌违纪违法的问题线索和主要情况，及时向纪检监察机关移送和报告。

  各地医保部门要高度重视定点医疗机构管理工作，切实加强领导、落实责任，加强与卫生健康、市场监管等部门的沟通，形成“资源配置均衡、就医便捷有序、服务合理必要、行业规范发展”的医保定点管理新格局。工作中要加强对医保和定点医疗机构工作人员的宣传培训，并做好社会面政策解读，及时回应群众关切，合理引导社会预期，凝聚改革共识。工作中遇有重大问题，及时向国家医保局报告。
